1) Eligibility & Account

• You must be at least 13 years old (or older where required) to use the Services.
• You are responsible for your account credentials and all activity under your account.
• Provide accurate information and keep it updated.

2) Marketplace Role

abuzzlist provides tools for users to create listings, discover items and services, and communicate. Unless expressly stated, abuzzlist is not a party to transactions between users. We do not handle buyer–seller funds, shipping, or quality assurance of goods/services.

3) User Content & License

• You retain ownership of content you post (listings, images, descriptions, messages, reviews, boards).
• You grant abuzzlist a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your content solely to operate, promote, and improve the Services.
• You represent that you have all rights necessary to post the content and that it does not infringe third-party rights.

4) Listings & Prohibited Items

You agree to follow all applicable laws and our guidelines. Prohibited content includes, without limitation:

• Illegal goods/services, stolen property, drugs/controlled substances, weapons/explosives.
• Adult sexual content or services, and content that is harassing, hateful, or violent.
• Counterfeit goods, infringing materials, and dangerous/unsafe items.
• Fraudulent, misleading, or deceptive listings.

We may remove or restrict content at our discretion.

5) Payments, Subscriptions, & Boosts

• abuzzlist processes SaaS subscriptions and promotional “boosts” via third-party processors (e.g., Stripe, PayPal, ApplePay). Buyer–seller payments occur externally and are not processed by abuzzlist.
• Subscriptions may auto-renew until canceled. You can cancel at any time in your account settings or via your app-store settings.
• Fees are generally non-refundable except as required by law or as stated during purchase.

6) Freshness & Moderation

• Listings may auto-expire after the configured duration unless renewed or extended with a paid boost.
• We may limit visibility or suspend/terminate accounts for policy violations, fraud, spam, or safety risks.
• Community reporting and admin review help keep the marketplace safe.

7) Messaging & Conduct

• Use Messaging for legitimate marketplace communications only.
• No spam, harassment, threats, or solicitation outside the transaction context.
• Respect others’ privacy and comply with applicable laws.

8) Safety

• Arrange meetups in public, well-lit places; consider cashless payments and buddy systems.
• Verify items and trust your judgment. abuzzlist is not responsible for user interactions or outcomes.

9) Intellectual Property

• Our trademarks, logos, code, and designs are owned by abuzzlist and protected by law. You may not use our IP without permission.
• We respect copyright. To submit a copyright complaint (DMCA), email support@abuzzlist.com with sufficient detail to locate the material and verify your rights.

10) Third-Party Services

The Services may link to or integrate with third-party services (e.g., social logins, maps, payment processors). We are not responsible for third-party terms or practices; review their policies before use.

11) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABUZZLIST AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID TO ABUZZLIST (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13) Indemnification

You agree to defend, indemnify, and hold harmless abuzzlist and its affiliates from any claims, losses, liabilities, and expenses (including attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

14) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Tarrant County, Texas.

15) Changes to the Services or Terms

We may modify the Services and these Terms from time to time. Continued use after changes become effective constitutes acceptance of the revised Terms.

16) Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or create risk/harm. Upon termination, certain provisions (e.g., IP, disclaimers, limitations, indemnity) will survive.
